INTRODUCTION<\/h4>\n<p><strong>1.1.<\/strong> 1.1 This Privacy Policy (\u201cPolicy\u201d) has the purpose of establishing the rules on the use, storage and Processing of Personal Data, which data was collected within the scope of Indovinya&#8217;s activities in digital media. The online platforms are available for access and use at Links <a href=\"https:\/\/staging.velxtecnologia.com\/rpma\/indovinya\">www.indovinya.indoramaventures.com<\/a>, among others websites that may be made available by Indovinya (\u201cSites\u201d) in the future, in accordance with the laws in force, in particular the General Personal Data Protection Law. <\/p>\n<p><strong>1.2.<\/strong> 1.2 As a condition for using the exclusive features of the Sites, you (\u201cUser\u201d) represents that you have fully and carefully read this document, being fully aware of its terms, and express your free agreement with the wording of this Policy.<\/p>\n<h4>2. DEFINITIONS<\/h4>\n<p><strong>2.1.<\/strong> 2.1 To make the Policy easier to read, we define some terms as below:<\/p>\n<ul>\n<li><strong>Anonymization<\/strong>: the process in which data has not the possibility of being directly or indirectly associated to an individual, using reasonable technical means that are available at the time of Personal Data Processing;<\/li>\n<li><strong>Activities<\/strong>: activities carried out and services provided by Indovinya, including, but not limited to, the services available in the area of investor relations (disclosure of information, financial results and other relevant interactions), the disclosure of Indovinya events and marketing actions, the recruiting and selection of new employees for job opportunities, and promoting of Indovinya <em>websites<\/em>, products and services;<\/li>\n<li><strong><em>Cloud Computing:<\/em><\/strong> is the delivery of different services through a network (e.g. Internet) and from the interconnection of more than one tool and application like data storage, servers, databases, networking, and software, in order to reduce costs and increase the availability of sustained services;<\/li>\n<li><em><strong>Cookies<\/strong><\/em> <strong>:<\/strong> small text files sent by the <em>Sites<\/em>, stored on User\u2019s respective devices, that store preferences and other information related to the User&#8217;s visit on the <em>Sites<\/em>, with the purpose of customizing their navigation according to their profile;<\/li>\n<li><strong>Data<\/strong>: any information entered, treated or transmitted for the performance of services related to the Activities and the use of the <em>Sites<\/em>;<\/li>\n<li><strong>Personal Data:<\/strong> Data related to any identified or identifiable natural person;<\/li>\n<li><strong>Profiling<\/strong>:any decisions that affect a user that, have been programmed to function automatically, without the need for human operation, based on automated Personal Data Processing;<\/li>\n<li><strong>Data Protection Officer or DPO<\/strong>:an agent responsible for and appointed by Indovinya to act as a communication channel between Indovinya, Users and Autoridade Nacional de Prote\u00e7\u00e3o de Dados (the National Data Protection Authority) (\u201cANPD\u201d);<\/li>\n<li><strong>Session ID<\/strong>:identification of an User&#8217;s session when an access to the <em>Sites<\/em> is made;<\/li>\n<li><strong>IP<\/strong>:short for <em>Internet Protocol;<\/em> is an alphanumeric set that identifies a user&#8217;s devices on the Internet;<\/li>\n<li><strong>General Personal Data Protection<\/strong> <strong>Law<\/strong>: Law Nr. 13,709\/18.<\/li>\n<li><strong><em>Link<\/em><\/strong><strong>:<\/strong> terminology for Internet address<strong>;<\/strong><\/li>\n<li><strong>Partners:<\/strong> companies that, through an agreement or contract with Indovinya, are authorized to offer rewards, discounts, products and services to User;<\/li>\n<li><strong>Processing:<\/strong> all operations performed with Personal Data, such as those concerning the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, disposal, assessment, control, modification, communication, transfer, dissemination or extraction of information; and<\/li>\n<li><strong>INDOVINYA: <\/strong>located in the City of S\u00e3o Paulo, State of S\u00e3o Paulo, at Avenida Brigadeiro Lu\u00eds Ant\u00f4nio, Nr. 1,343, 10th floor, registered with the National Corporate Taxpayers Register under CNPJ Nr. 33.256.439\/0001-39<strong>.<\/strong><\/li>\n<\/ul>\n<h4>3. THE COLLECTION OF PERSONAL DATA<\/h4>\n<p><strong>3.1.<br \/>\nComo os Dados S\u00e3o Coletados <\/strong>.<br \/>\nOs Dados, incluindo Dados Pessoais, poder\u00e3o ser coletados quando o Usu\u00e1rio<br \/>\n(i) os submete;<br \/>\n(ii) faz uso dos <em>Sites<\/em>; ou (iii) quando participa de suas Atividades.<br \/>\nOs Dados coletados, bem como a raz\u00e3o para sua coleta, incluem:    <\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone wp-image-1074 size-full\" src=\"https:\/\/staging.velxtecnologia.com\/rpma\/indovinya\/wp-content\/uploads\/2024\/09\/Item_3_Politica_de_Privacidade.jpg\" alt=\"\" width=\"720\" height=\"1040\" srcset=\"https:\/\/staging.velxtecnologia.com\/rpma\/indovinya\/wp-content\/uploads\/2024\/09\/Item_3_Politica_de_Privacidade.jpg 720w, https:\/\/staging.velxtecnologia.com\/rpma\/indovinya\/wp-content\/uploads\/2024\/09\/Item_3_Politica_de_Privacidade-208x300.jpg 208w, https:\/\/staging.velxtecnologia.com\/rpma\/indovinya\/wp-content\/uploads\/2024\/09\/Item_3_Politica_de_Privacidade-709x1024.jpg 709w\" sizes=\"(max-width: 720px) 100vw, 720px\" \/><\/p>\n<p><strong>3.2.<br \/>\nDados Necess\u00e1rios <\/strong>3.1 How Data Is Collected. Data, including Personal Data, may be collected when User (i) submits it; (ii) access the <em>Sites<\/em>; or (iii) participates in its Activities. The Data collected, as well as the reason for its collection, include: <\/p>\n<p><strong>3.3.<br \/>\nAtualiza\u00e7\u00e3o e Veracidade dos Dados: <\/strong> 3.2. Required Data: the <em>Sites<\/em> functionalities depend directly on some Data provided in the table above, especially the <em>User&#8217;s<\/em> Registration Data. If User chooses not to provide some of such Data, they may be unable to participate in the Activities. <\/p>\n<p><strong>3.3.1.<\/strong> Likewise, Indovinya shall not be obliged to process any of the User Personal Data if there is reason to believe that such Personal Data Processing may cause any violation of any applicable law, or if it is verified that User is providing Data, making use of the <em>Sites<\/em> and\/or participating in its Activities for any illegal, unethical, unlawful or contrary to morality purposes.<\/p>\n<p><strong>3.4.<br \/>\nBase de Dados:   <\/strong>3.4. Database: the database formed through the collection of Data is the property and responsibility of Indovinya, and its use, access and sharing, when necessary, shall be made within the limits and purposes of the business described in this Policy.<\/p>\n<p><strong>3.5.<br \/>\nDados de Menores: <\/strong> 3.5. Child and Adolescent Data: our platforms are not intended for persons under 18 (eighteen) years of age, so we do not knowingly collect or perform any kind of Personal Data Processing in connection with such Data. If User does not have the minimum age required, they shall not register on the <em>Sites<\/em> or access them without the representation of their parents, guardians or trustees, under the terms of law. If we unintentionally identify Personal Data of minors in our database, we shall remove such Data.  <\/p>\n<p><strong>3.6.<br \/>\nTecnologias Empregadas: <\/strong> 3.6. Technologies Used: Indovinya uses <em>Cookies<\/em> technology, and User may block them by setting their Internet browser. In this case, some features that are offered by the <em>Sites<\/em> may be limited. <\/p>\n<p><strong>3.6.1.<\/strong> 3.6.1. The technology used by Indovinya shall always comply with the current legislation and the terms of this Policy.<\/p>\n<p><strong>3.7.<\/strong> Durante a utiliza\u00e7\u00e3o dos <em>Sites<\/em>, a Indovinya poder\u00e1 empregar Decis\u00f5es Unicamente Automatizadas, de forma a aprimorar a experi\u00eancia do Usu\u00e1rio, nos termos do disposto nesta Pol\u00edtica e em conformidade com a legisla\u00e7\u00e3o vigente.<\/p>\n<h4>4. COMO DADOS E INFORMA\u00c7\u00d5ES S\u00c3O COMPARTILHADOS<\/h4>\n<p><strong>4.1.<br \/>\nHip\u00f3teses de Compartilhamento dos Dados <\/strong>.<br \/>\nOs Dados coletados e as atividades registradas podem ser compartilhados, sempre respeitando o envio do m\u00ednimo de informa\u00e7\u00f5es necess\u00e1rias para atingir as finalidades descritas nesta Pol\u00edtica: <\/p>\n<p><strong>(i)<\/strong> com Parceiras cuja atua\u00e7\u00e3o seja necess\u00e1ria \u00e0 execu\u00e7\u00e3o das Atividades ou para benef\u00edcio do Usu\u00e1rio, sendo certo que sempre ser\u00e1 exigido de tais Parceiras o cumprimento das diretrizes de seguran\u00e7a e prote\u00e7\u00e3o de Dados, conforme item 5.5 desta Pol\u00edtica;<\/p>\n<p><strong>(ii)<\/strong> com empresas contratadas para a presta\u00e7\u00e3o de servi\u00e7os operacionais inerentes aos <em>Sites<\/em> e ao exerc\u00edcio das Atividades, sendo certo que sempre ser\u00e1 exigido de tais organiza\u00e7\u00f5es o cumprimento das diretrizes de seguran\u00e7a e prote\u00e7\u00e3o de Dados, conforme item 5.5 desta Pol\u00edtica; e<\/p>\n<p><strong>(iii)<\/strong> com autoridades judiciais, administrativas ou governamentais competentes, sempre que houver determina\u00e7\u00e3o legal, requerimento, requisi\u00e7\u00e3o ou ordem judicial.<\/p>\n<h4>5. COMO OS DADOS S\u00c3O PROTEGIDOS E COMO O USU\u00c1RIO TAMB\u00c9M PODER\u00c1 PROTEG\u00ca-LOS<\/h4>\n<p><strong>5.1.<br \/>\nCompartilhamento de Senhas: <\/strong> o Usu\u00e1rio tamb\u00e9m \u00e9 respons\u00e1vel pelo sigilo de seus Dados e deve ter sempre ci\u00eancia de que o compartilhamento de senhas e Dados de acesso viola esta Pol\u00edtica e pode comprometer a seguran\u00e7a dos seus Dados, dos <em>Sites<\/em> e suas Atividades.<\/p>\n<p><strong>5.2.<br \/>\nCuidados que o Usu\u00e1rio Deve Tomar: <\/strong> \u00e9 muito importante que o Usu\u00e1rio proteja seus Dados contra acesso n\u00e3o autorizado ao seu computador, conta ou senha, al\u00e9m de se certificar de sempre clicar em \u201csair\u201d ao encerrar sua navega\u00e7\u00e3o em um computador compartilhado. Caso o usu\u00e1rio desconfie que sua senha possa ter sido exposta\/comprometida, o mesmo dever\u00e1 alter\u00e1-la de forma tempestiva evitando a exposi\u00e7\u00e3o das informa\u00e7\u00f5es protegidas por esta senha. \u00c9 igualmente importante que o Usu\u00e1rio saiba que a Indovinya nunca enviar\u00e1 mensagens eletr\u00f4nicas com anexos que possam ser executados (extens\u00f5es: .exe, .com, entre outros).  <\/p>\n<p><strong>5.3.<br \/>\nAcesso aos Dados Pessoais, Proporcionalidade e Relev\u00e2ncia <\/strong>: na Indovinya, os Dados Pessoais coletados somente ser\u00e3o acessados por profissionais devidamente autorizados, respeitando os princ\u00edpios de proporcionalidade, necessidade e relev\u00e2ncia para os objetivos das Atividades, al\u00e9m do compromisso de confidencialidade, prote\u00e7\u00e3o de Dados Pessoais e preserva\u00e7\u00e3o da privacidade do Usu\u00e1rio nos termos desta Pol\u00edtica.<\/p>\n<p><strong>5.4.<em> Links<\/em><\/strong><strong> Externos:<\/strong> quando o Usu\u00e1rio utilizar os <em>Sites<\/em>, ele poder\u00e1 ser direcionado, via <em>Link<\/em>, a outros portais ou plataformas, que poder\u00e3o coletar as informa\u00e7\u00f5es do Usu\u00e1rio e possuir sua pr\u00f3pria pol\u00edtica de privacidade e Tratamento de Dados Pessoais.<\/p>\n<p><strong>5.4.1.<\/strong> Caber\u00e1 ao Usu\u00e1rio ler as pol\u00edticas de privacidade e Tratamento de Dados Pessoais adotadas por tais portais ou plataformas externas, sendo de sua responsabilidade aceit\u00e1-las ou rejeit\u00e1-las. A Indovinya n\u00e3o \u00e9 respons\u00e1vel pelas pol\u00edticas de terceiros e ou pelo conte\u00fado de quaisquer <em>websites<\/em> ou conte\u00fado dos servi\u00e7os ligados a ambientes que n\u00e3o sejam os dos <em>Sites<\/em>. <\/p>\n<p><strong>5.4.2.<\/strong> O Usu\u00e1rio tamb\u00e9m poder\u00e1 ser redirecionado aos <em>websites <\/em>de empresas direta ou indiretamente controladas pela Indovinya. Como esta Pol\u00edtica endere\u00e7a apenas os <em>Sites<\/em>, o Usu\u00e1rio dever\u00e1 ficar atento \u00e0s regras de uso e privacidade de tais <em>websites<\/em>. <\/p>\n<p><strong>5.5.<br \/>\nServi\u00e7os das Parceiras: <\/strong> a Indovinya poder\u00e1 firmar contratos com Parceiras que oferecer\u00e3o servi\u00e7os e\/ou produtos diretamente ao Usu\u00e1rio, cujos termos e condi\u00e7\u00f5es poder\u00e3o ser acessadas por meio de informativos da Indovinya enviados pelos nossos canais de comunica\u00e7\u00e3o oficiais. Os Dados fornecidos diretamente pelo Usu\u00e1rio a estas Parceiras ser\u00e3o de exclusiva responsabilidade das Parceiras, estando assim sujeitos \u00e0s suas pr\u00f3prias pr\u00e1ticas de coleta e uso de Dados. <\/p>\n<p><strong>5.6.<br \/>\nProcessamento por terceiros sob diretriz da Indovinya <\/strong>: caso empresas terceirizadas realizem o Tratamento de Dados Pessoais em nome da Indovinya , elas dever\u00e3o respeitar as condi\u00e7\u00f5es estipuladas nesta Pol\u00edtica e nas normas de seguran\u00e7a da informa\u00e7\u00e3o adotadas pela Indovinya.<\/p>\n<h4>6. COMO S\u00c3O ARMAZENADOS OS DADOS PESSOAIS E O REGISTRO DE ATIVIDADES<\/h4>\n<p><strong>6.1.<\/strong> Os Dados Pessoais coletados e os registros das Atividades s\u00e3o armazenados em ambiente seguro e controlado durante o tempo em que sejam necess\u00e1rios para a realiza\u00e7\u00e3o do Tratamento de Dados Pessoais, ficando, ainda, assegurada \u00e0 Indovinya a prerrogativa de permanecer com o hist\u00f3rico de registro dos Dados do Usu\u00e1rio, para fins de auditoria, seguran\u00e7a, controle de fraudes e preserva\u00e7\u00e3o de direitos nas hip\u00f3teses estabelecidas por lei ou norma regulat\u00f3ria ou para a preserva\u00e7\u00e3o de direitos.<\/p>\n<p><strong>6.2.<\/strong> A Indovinya poder\u00e1 contratar servi\u00e7os de armazenagem de dados em nuvem de servidores localizados fora do Brasil. Caso isso ocorra, a Indovinya contratar\u00e1 servi\u00e7os de <em>Cloud Computing<\/em> que possuam toda a estrutura t\u00e9cnica, organizacional e administrativa que garanta a seguran\u00e7a e integridade dos Dados Pessoais, bem como que estejam em conformidade com os princ\u00edpios e obriga\u00e7\u00f5es relacionados ao Tratamento de Dados Pessoais. <\/p>\n<h4>7. QUAIS S\u00c3O OS DIREITOS DOS USU\u00c1RIOS E COMO EXERC\u00ca-LOS<\/h4>\n<p><strong>7.1.<br \/>\nDireitos B\u00e1sicos: <\/strong> o Usu\u00e1rio poder\u00e1 solicitar ao Encarregado, pelo canal de atendimento a titulares dispon\u00edvel em (<a href=\"http:\/\/portaldeprivacidade.oxiteno.com\/\" target=\"_blank\" rel=\"noopener\">portaldeprivacidade.oxiteno.com<\/a>):<\/p>\n<p><strong>(i)<\/strong> a confirma\u00e7\u00e3o da exist\u00eancia Tratamento de Dados Pessoais;<\/p>\n<p><strong>(ii)<\/strong> a exibi\u00e7\u00e3o e\/ou retifica\u00e7\u00e3o de seus Dados;<\/p>\n<p><strong>(iii)<\/strong> solicitar a exclus\u00e3o ou Anonimiza\u00e7\u00e3o de seus Dados Pessoais que tenham sidos coletados.<\/p>\n<p><strong>7.2.<\/strong> Se o Usu\u00e1rio se opuser ao Tratamento de Dados Pessoais vinculado a finalidades fundamentais, de forma a impactar o regular funcionamento das Atividades e dos Sites, o Usu\u00e1rio dever\u00e1 ter ci\u00eancia de que n\u00e3o ter\u00e1 acesso \u00e0s Atividades e \u00e0s funcionalidades oferecidas pelos Sites.<\/p>\n<p><strong>7.3.<\/strong> Findos o prazo de manuten\u00e7\u00e3o e a necessidade legal, os Dados Pessoais ser\u00e3o exclu\u00eddos com uso de m\u00e9todos de descarte seguro ou utilizados de forma anonimizada para fins estat\u00edsticos.<\/p>\n<h4>8.
